Please find here below General Terms and Conditions that apply to the website and web shop of The Secret of Ogimi.
Our General Terms and conditions apply to all transactions made online with The Secret of Ogimi. Please read them carefully before you place any orders. All agreements are subject to and will be interpreted in accordance with Belgian Law. All disputes, if any, between parties will be settled exclusively by Belgian Court. Nor things in these General Conditions shall be deemed to affect your statutory rights.
By making use of this website, you accept these General conditions. All transactions made with The Secret of Ogimi are subject to these General Conditions.
Words such as: ‘we’, ‘the company’, ‘us/our’ always refer to The Secret of Ogimi. Words such as ‘customer’ always refer to the person or persons who purchase(s) goods from the company or agree(s) to purchase goods.
Every reference to the website and web shop implies a reference to all URLs that are the property of The Secret of Ogimi.
All our prices are stated in Euros. They include VAT at the applicable rate, unless clearly stated otherwise. All prices are subject to change without any prior notice. We check prices and specifications on our website and web shop to the best of our ability, however we cannot be held liable for any errors that might occur. As mentioned before, we reserve the right to change our prices and specifications without prior notice.
Please find here instructions on ordering products from our web shop. In order to purchase a product or multiple products, you will first need to follow instruction and add the product to your shopping basket. After completing your order, you will be required to enter your contact and invoicing details. After this you will be requested to select the way of payment. Only after selecting the way of payment, and all details in order to complete the payment 100%, your purchase will be confirmed.
We accept orders through online transactions via a secure server. All transactions using credit and debit cards are subject to verification and the authorization of the card issuer. We cannot be held responsible in case of any payments that occurred whit stolen credit cards. In this case you will always need to contact your credit card company.
We accept the following ways of payment: Visa, MasterCard, PayPal, Bancontact…
If your card issuer refuses to authorize your payment to us, we cannot be held liable for any shipping delays or a non-delivery of your order. Orders without a valid payment in the name of the registered card holder will not be accepted or processed. We will not keep the item reserved and you will need to follow the order process from the beginning in order to make a new purchase.
Ordered products will be delivered as quickly as possible in accordance with the requested shipping method and the availability of the product. All shipping costs are subject to change without prior notice and depend on the selected way of shipment. If a product is available in stock at the time of ordering, the maximum time of delivery will be 30 days following the day after the order was placed. At the moment we ship our goods 1 x per week. If we are unable to deliver your goods within the 30 days, we will notify you about the delay and inform you on the expected delivery date. In the case of a delay in delivery , more than 30 days after placing the order, you have the right to cancel the undelivered orders/product(s). The cancellation request will need to take place within 7 days after receiving the notification of the delay and needs to be completed by writing and sending an email to the att of: email@example.com. If the payment has already been made, you will receive a full refund for the items or products in question.
Damaged products: If the products we delivered have been damaged, caused by the shipment or do not correspond to the items on the delivery note, nor are the items your ordered, you are required to notify us by writing us an email and returning the items within 7 calendar days following the receipt of the delivery. The shipping cost of returning the item are paid by the sender, in this case the customer. If we didn’t receive such notification within the 7 calendar days after receipt of the delivery, the customer will be deemed to have accepted the items and to be satisfied with them. We cannot be held liable for any consequential damage due to late delivery or non-delivery by the carrier engaged by the company. Our liability in such instances is limited to the value of the items which it has been demonstrated were not received by the customer.
Our Return & Exchange Policy:
The Secret of Ogimi wants you to be completely satisfied with every purchase you make with us. We will do everything we can to offer you excellent quality, a good value for money and an excellent customer service. The products we keep in our assortment are carefully selected by us in countries such as Indonesia and Morocco. The items we have selected are handmade and therefore every single item is unique of its kind. As we use natural products such as rattan, suar wood, teak wood and cotton, please note that some of the products might have a flaw. This makes it unique. However if you are not happy with the product you received and wish to return it, please fill out an email with the CAPTION: Return, the date of receipt, and the reason. All products which are returned should be returned in excellent condition and unused. The way of returning the item (shipment) should be done in a way the items will not be damaged because of poor packaging. Returning the product(s) should be done within 7 calendar days after receiving the delivery. A copy of the delivery note (original) should be send together with the return shipment. Shipping costs of returning the items are paid by the sender, in this case the customer. If the returned product(s) are in good and unused state, we will exchange the product
or make a refund to the customer. The time in order to receive the refund and/or the exchange may take up to max. 20 days after the items have returned to The Secret of Ogimi return address.
All offered products are subject to warranty against manufacturing or material defects, minor flaws don’t fall under warranty. The warranty last 12 months, starting from the date of the original invoice. Defects caused by usage, accidents, negligence or injudicious use are not covered by the warranty.
To make a warranty claim, you need to return the item, together with sending an email to: The Secret of Ogimi, with the CAPTION: return under warranty. The return address is to be found on the delivery note.
We make every effort to ensure that the colours on the website match those of the actual products as closely as possible. Please note that we work with natural materials which have a nature of having differences in colour and size. Also handmade items are created as it says: manually and therefore sometimes have little flaws, which makes them interesting and unique. The Secret of Ogimi does not offer refunds, replacements or exchanges arising from the look of the materials as described here. The customer accepts the possibility of minor flaws and differences in colour and size when purchasing items from our Collection.
Due to differences in local temperatures at product location and final destination, some of our materials such as wood might response to temperature difference and humidity variations. Your items can experience movements and cracks as it adjusts to local situations, this is not a fault, but a natural occurrence taking place within the fibers of a natural product. Many of our timber ranges are wood with character and have an appearance of naturally occurring knots. Variety of colours, grains and knots found in wood simply underline the character of the timber and are not seen as a defect or faulty.
Every piece of timber is unique in its kind and the customer should expect a variety of tones, veins, grain pattern, leaching, cracking and knots.
None of the above is seen as a fault. We embrace these changes as the natural characteristics and beauty of timber furniture.
Regulation on distance sale:
In accordance with the regulations on distance sales you have the right to cancel any order placed via the website within 7 calendar days from the delivery date with a refund, provided that the good have not been used and are in original state. This does not apply to perishable goods, unsealed software or items that were personalized or manufactured according to your instructions.
In order to cancel an item, you can send us an e-mail to firstname.lastname@example.org, notifying your customer number and the number of your order. You need to take reasonable care of items and retail all original packaging and must not use the item. Items must be returned within 7 calendar days after you have sent us your cancellation message. Items can be returned to our customer service (see contact details). All items will be returned at your expense, unless this concerns damaged or incorrect items, in which case we will refund the costs when we receive the items. If we receive the items in unused condition and in their original packaging with all accessories, you will receive your refund within 30 days of your cancellation message.
We are not responsible for failure to comply with our obligations if this is the consequence of or is cause by labour disputes or any other circumstances that are reasonably beyond the company’s control such as situations of force majeure, civil unrest or riots, floods, fire, strikes, earthquakes, lock-outs, transportation problems and promulgation of laws. If it becomes impossible due to such circumstances for the company to deliver the ordered items in whole or in part within a reasonable timespan, the customer’s liability will be limited to the value of the items already delivered, increased by any associated shipping costs.
Any information appearing on our website or which can be read in any other printed material of the company is deemed to be non-binding or is recognized as best practice. This should only be deemed useful supplementary advice in addition to other recognized practical guidelines. All information on our website is regularly updated.
Prices and printing errors:
We check prices and specifications to the best of our ability, but although we make every effort to ensure that they are correct, we cannot be held liable for errors and omissions. We reserve the right to change our prices and specifications without prior notice.
Title to goods:
All items supplied to the customer remain the property of The Secret of Ogimi until we have received all amounts due for the items in question.
All complaints and comments can be sent to our customer service , contact e-mail: email@example.com. We will use our best endeavors to deal with your complaint within 5 to 7 working days. If we cannot resolve your complaint immediately, we will inform you of the expected time and keep you informed of all enquiries.
We make every effort to protect the safety of users of our online ordering service. We make use of SSL technology to secure your data during all sales transactions with us. Any information you provide is fully encrypted so that third parties cannot read it.
Right of Withdrawal:
You have the right to withdraw from the agreement within a period of 7 days without indicating the reasons. The right of withdrawal expires after 7 days you or a third party appointed by you, other than the carrier, takes physical possession of the last batch or article.
In order to exercise the right of withdrawal, you must inform The Secret of Ogimi, Bruggelandenstraat 15, 3120 Tremelo, +32 473733314/+32 495 521904, firstname.lastname@example.org about your intention to withdraw from this agreement, through explicit declaration (e.g. through mail or email) In order to comply with the withdrawal term, please send the notice relative to your decision to exercise the right of withdrawal before the right of withdrawal period expires.
Effects of Withdrawal:
If you decide to withdraw from the agreement that was previously made, we will refund all the payments that you have made, including the delivery costs (with the exception of additional costs in case you chose a type of delivery other than the least expensive standard delivery option offered by The Secret of Ogimi, without any undue delay and in any case no longer than 7 days after we were informed about your decision to withdraw from the agreement. We will make refunds by using the same payment method that was initially chosen for the transaction, unless explicitly agreed otherwise. In any case, you will not incur any cost, as consequence of said refund.
We have the right to wait to refund you until we have received all returned purchases, or until you have proven that you have shipped all purchases for withdrawal, according to which date occurs first.
You have to return the goods or submit them without undue delays and in any case, within 7 days from the day you notified us your intention to withdraw from this agreement. The term is respected if you return the goods prior to the expiry of the 7-day term.
